These Terms of Service (the “Terms”) govern the use of the mobile applications and related services (collectively, the “Services”) provided by SMARTWHO Inc. (the “Company”). The purpose of these Terms is to set forth the rights, obligations, and responsibilities of the Company and users in connection with the use of the Services, as well as other necessary matters.
1. Purpose
The purpose of these Terms is to define the rights, obligations, and responsibilities of the Company and users in connection with the use of the Company’s mobile applications and online services.
2. Definitions
- “Services” means the twelve (12) mobile applications provided by the Company, together with all related features and ancillary services.
- “User” means any member or non-member who agrees to these Terms and uses the Services provided by the Company.
- “Member” means an individual who has entered into a service use agreement with the Company and holds an account.
- “Non-member” means an individual who uses the Services without completing a separate membership registration process.
3. Effect and Amendment of the Terms
- These Terms apply to all users who wish to use the Services.
- The Company may amend these Terms to the extent such amendments do not violate applicable laws and regulations, where there are reasonable grounds such as changes in laws or policies.
- Any amended Terms will be announced in advance through notices within the Services or on the Company’s website and will take effect as of the date specified in the announcement.
4. Formation of the Service Use Agreement
- The service use agreement is formed when the user agrees to these Terms.
- The Company may restrict the formation of such agreement if there are technical, legal, or operational reasons.
5. Protection of Personal Information
- In operating the Services, the Company does not directly collect or store users’ personal information.
- However, in certain apps, statistical data that are not directly linked to personal information (de-identified information) may be collected and used for quality improvement, service stabilization, and error analysis.
- In addition, for in-app advertising, the Company may use advertising networks provided by Google and its partners (e.g., Google AdMob). In the course of this, non-personal information (e.g., advertising ID, device type, language settings, interest-based advertising data) may be collected.
- The data collection and processing described above are performed by third-party systems such as Google. The Company does not identify specific individuals using such data.
- Users can manage ad personalization and related data use via their Android device’s Google account or device settings (e.g., reset advertising ID, limit personalized ads).
- The Company complies with applicable laws and does not provide any information, including personal information, to third parties without lawful basis.
6. Data Retention and Destruction
- As the Company does not directly collect or store personal information, there is no subject of personal information retention or destruction on the Company’s side.
- However, during app operation, non-personal information may be processed and stored through tools provided by Google or other third-party services (e.g., Google Firebase, Google Analytics, AdMob). In such cases, the responsibility for managing those data lies with Google and the respective service providers.
7. Provision and Modification of the Services
- The Company provides the Services to users in a stable manner.
- The Company may modify the Services, in whole or in part, as necessary for business or technical reasons, and any material changes will be announced in advance.
8. Suspension of the Services
- The Services may be unavoidably suspended due to equipment inspection, replacement, malfunction, communication failure, force majeure, or other events beyond the Company’s control.
- If any of the foregoing events occurs, the Company will provide notice without undue delay.
9. User Obligations
Users shall not engage in any of the following acts:
- Misappropriation of others’ information;
- Infringement of the rights of the Company or any third party;
- Acts in violation of laws or contrary to public order and morals;
- Acts that interfere with the operation of the Services.
10. Intellectual Property Rights and Use Restrictions
- Copyrights in the content created by the Company within the Services belong to the Company.
- Users may not, without the prior consent of the Company, reproduce, distribute, transmit, publish, broadcast, or otherwise use materials within the Services.
11. Limitation of Liability
- The Company shall not be liable where the provision of the Services is rendered difficult due to force majeure, acts of God, or reasons attributable to the user.
- The Company does not guarantee any results or profits that users may expect from the Services.
12. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Korea.
- Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company’s principal place of business as the court of first instance.
Addendum
These Terms shall take effect on September 25, 2025.
